This document is an informational translation of the original Polish version. If the versions differ, the Polish text governs to the extent permitted by mandatory law, in particular mandatory consumer-protection rules.
1. Definitions
- Service
- The QrKontakt platform available at qrkontakt.com, providing the services described in these Terms.
- Provider
- ADAKS MEDIA DANIEL DOBROWOLSKI, Polish tax ID (NIP): 6152062671, address: Mściszów 112B, 59-800 Lubań, Poland, email: [email protected].
- User
- Any natural or legal person who uses the Service after creating an account and agreeing to these Terms.
- Consumer
- A User who is a natural person acting for purposes outside their trade, business, or profession.
- QR Sticker
- A physical adhesive sticker containing a QR Code, intended for a car, keys, bicycle, wallet, luggage, equipment or another item chosen by the User.
- QR Code
- A unique 20-character alphanumeric code (A-Z, 0-9) in XXXXX-XXXXX-XXXXX-XXXXX format, together with the technical QR token used in the sticker's public URL.
- Contact Form
- A Service feature allowing a message to be sent to the owner of a marked item after scanning a QR Code.
- Subscription
- The one-year validity period of the complete QrKontakt service assigned to a sticker, including its public page, messages, Lost Mode GPS, email, push and activity.
2. General Provisions
- These Terms govern the use of the QrKontakt Service, including the terms for entering into and terminating service agreements.
- By using the Service, you agree to be bound by these Terms.
- The Provider operates under Polish law, including the Act of 18 July 2002 on the provision of services by electronic means and the Act of 30 May 2014 on consumer rights.
- To use the Service, you need: an internet-connected device, a JavaScript-capable browser, and an active email address.
- These Terms are made available free of charge before entering into an agreement and in a way that allows them to be saved, reproduced and retained.
3. Account Registration
- Registration is free and requires providing an email address, name, and password, or logging in via Google/Apple OAuth.
- You must provide accurate information. Providing false data constitutes a breach of these Terms.
- You must be at least 18 years old to create an account. Minors may only use the Service with parental or guardian consent and supervision.
- Each User may hold only one account. Creating multiple accounts to circumvent limits or bans is prohibited.
- You are responsible for maintaining the confidentiality of your login credentials and all activities on your account.
- Your email address must be verified by clicking the activation link sent to the provided address.
- The Provider reserves the right to suspend or delete an account that breaches these Terms, following prior notice to cease the breach.
- You may delete your account at any time. Deletion is initiated in your profile settings after password confirmation, or — for OAuth accounts — by contacting [email protected].
- A confirmed deletion request starts a 7-day cancellation period during which the account remains active. The account, sessions, device tokens and stickers are then deactivated, and remaining personal data is deleted or anonymised no later than 30 days after the original request. Statutory accounting records and limited audit data are retained as described in the Privacy Policy.
- Upon account deletion, all QR stickers linked to the account are deactivated and cannot be recovered.
4. QR Stickers — Ordering, Activation & Deactivation
- QR Stickers are physical products ordered through the Service and delivered to the specified postal address.
- Each sticker has a unique QR Code linked to the User's account. One sticker cannot be assigned to multiple accounts.
- Activation requires the signed-in User to scan or enter the activation code in the supported app or dashboard flow. A third party's ordinary visit to the public QR page does not activate the sticker.
- A User may deactivate a sticker at any time from their dashboard, which will display an unavailability page instead of the contact form.
- Stickers are intended for lawful use only, specifically for placement on the window of the User's own vehicle.
- Reselling or transferring a QR Code to other individuals or platforms requires written consent from the Provider.
5. Anonymous Contact Service
- The contact form allows the person scanning a QR Code to send a message to the User without disclosing the sticker owner's contact details to the sender.
- The message is stored in the User's account and a notification is delivered through the channels enabled by the User: email or push.
- When the account registers a push notification token for the first time, the Service performs a one-time disabling of the email channel and all email event notifications, leaving push notifications enabled. The User may later re-enable selected email notifications in the website or mobile app settings; registering another token or device does not reset those choices again.
- The sender may provide their name, email address and phone number, unless they choose anonymous sending. Details provided by the sender may be visible to the User who owns the sticker.
- Messages, attachments and anti-spam technical identifiers are retained for the period stated in the Privacy Policy.
- The use of the contact form for the following is strictly prohibited:
- spam, unsolicited advertising, or commercial communications;
- harassment, threats, hate speech, racist, sexist, or discriminatory content;
- malware distribution or phishing;
- solicitation of personal or financial data;
- any activity that is unlawful under applicable law.
Violations may result in message removal, sender blocking, restriction of access to features or reporting to competent authorities where required by law.
Reporting illegal content
To the extent the Service stores user-provided content, illegal content notices may be sent to [email protected]. A notice should include a description of the content, reasons why it is considered illegal, contact details of the reporter and, where possible, a link, message identifier or other information allowing us to locate it. The Provider reviews notices without undue delay, and moderation decisions may be challenged by contacting support.
5a. Content Moderation and Administrator Access to Messages
- The Provider reserves the right to review the content of messages (including attachments) sent through the QrKontakt contact form for the purposes of content moderation, abuse prevention and compliance with applicable law.
- On the basis of such review, the Provider may:
- remove a message that violates these Terms or applicable law;
- block a sender (by browser fingerprint) from further use of the contact form;
- suspend or close the account of a User who misuses the platform.
- Users acknowledge that — although messages are intended to reach the sticker owner — the Provider has technical access to message content solely for the limited purposes described in this section.
- Full information on the legal basis, scope, safeguards and applicable rights in connection with administrator access to messages is set out in the Privacy Policy, in the section on message moderation.
§ 5b. Lost Mode and Location Sharing
- The Owner may activate "Lost Mode" within the dashboard when the item bearing the sticker is lost.
- While active, the item's public page displays a prominent red banner indicating the item is lost and provides a button for the finder to share their GPS location.
- Sharing GPS coordinates is strictly voluntary for the finder and requires prior confirmation via a pre-consent modal.
- The Owner agrees to process the received GPS data strictly for the purpose of recovering the lost item. The Owner must not share this data with third parties, use it for tracking individuals, and is obligated to delete it promptly once the item is recovered or the data is no longer needed.
- QrKontakt stores latitude, longitude and optional accuracy as a GPS message, makes it available to the Owner in the app or dashboard and may also send it by email. GPS data is retained for no more than 30 days as described in the Privacy Policy.
- The Owner is solely responsible for the lawful processing of any received GPS data in accordance with the GDPR and applicable privacy laws.
§ 5c. Public Sticker Data and Reporting Violations
- The sticker name, Owner message, phone labels and phone numbers displayed on a sticker's public page are content supplied and voluntarily published by the User. The User is responsible for ensuring that this content is lawful, accurate and current and that the User holds all rights required to publish it.
- Public sticker data must not contain unlawful or prohibited material, threats, incitement to violence, hate speech, obscene, fraudulent or misleading content, or infringe privacy, personality rights, intellectual property rights or any other rights of third parties.
- A User may publish only a phone number that the User lawfully uses or another person's number where that person has given prior, informed and demonstrable consent to its public display and to receiving contacts related to the sticker.
- The User must promptly remove or update a number and other data if the User loses the right to use it, consent is withdrawn, the number is reassigned to another person, or the data becomes outdated.
- Any visitor to the public page may use the "Report sticker" feature to select a reason and describe a violation. Knowingly false, malicious, automated or repeated reports intended to harass a person or disrupt the Service are prohibited.
- Following a report or a reasonable suspicion of a violation, the Provider may preserve a copy of the content as evidence, restrict its visibility, remove it, temporarily disable sticker or account features, request an explanation, or notify a competent authority where required by law. Measures will be proportionate to the nature and risk of the violation.
- A serious or repeated violation, in particular one confirmed after an individual review of one or more substantiated reports, may result in the permanent and irreversible blocking of the sticker. The number of reports alone does not determine a block. The User will be informed of the principal reasons for the decision and may challenge it through support, unless the law restricts disclosure. A block resulting from unlawful conduct or a violation attributable to the User does not entitle the User to a pro-rata refund for the unused period, subject to mandatory consumer rights and claims arising from the Provider's failure to perform or improper performance of the contract.
- The User is responsible for claims arising from data published by the User or from the absence of required consent, subject to mandatory consumer protection laws.
6. Subscription and Pricing
- Current pricing is available at qrkontakt.com in the "Pricing" section.
- QR Stickers are available in the following packages:
- Single — 1 QR sticker
- Trio — 3 QR stickers
- Quintet — 5 QR stickers
- Deca — 10 QR stickers
- Each sticker package includes one year of Service validity for each sticker, starting on activation. The renewal price is shown in the current price list and before the order is placed.
- Renewals are manual only and require a new User action and payment confirmation each time. The Service does not automatically charge a card or bank account for subsequent years.
- Early renewal preserves remaining time: the new expiry is one year after the later of the current expiry date and payment capture.
- After expiry, the public page displays an inactive state. The contact form, messages and attachments, GPS sharing, email, push and new activity entries are disabled until successful renewal.
- Prices are in Polish Zloty (PLN) and include VAT where applicable.
- The Provider reserves the right to change prices with 30 days' notice for active subscriptions.
- Notifications related to a specific sticker are available only during that sticker's active validity/subscription period. The Provider may send service notices about renewal, payments, security or Service changes independently of marketing settings. The Provider reserves the right to discontinue the Service with 90 days' notice.
7. Payments
- Payments are processed by:
- Stripe Inc. — card payments (Visa, Mastercard, American Express)
- PayNow (mBank S.A.) — BLIK, online bank transfers, other Polish payment methods
- Card and bank account data is not stored on the Provider's servers — it is processed directly by the payment provider.
- A VAT invoice or receipt is issued promptly after payment confirmation and sent to the User's email address.
- If a manual renewal payment fails, the order remains unpaid or expires. The Provider does not retry the charge automatically; the User may initiate another payment.
8. Shipping and Delivery
- QR Stickers are shipped via Furgonetka.pl (Apaczka S.A.) courier services or Polish Post.
- Estimated delivery time within Poland: 2–5 business days from the moment the order is accepted for fulfilment.
- Shipping costs are displayed in the cart before checkout and depend on the selected delivery method.
- Orders above a specified threshold (shown in the pricing page) qualify for free shipping.
- The Provider delivers within the Republic of Poland only. International shipping is available on request.
- The Provider remains responsible towards Consumers for delivering goods in conformity with the contract. Carrier delays are handled through carrier contact and the complaint procedure without limiting Consumers' statutory rights.
9. Prohibited Content and Conduct
Users must use the Service lawfully and in accordance with these Terms. The following are prohibited:
- infringing intellectual property rights of third parties;
- uploading or transmitting illegal, offensive, defamatory, or harmful content;
- attempting unauthorised access to the Service, other Users' accounts, or the Provider's IT infrastructure;
- automated data scraping without the Provider's written consent;
- disrupting the Service (DoS/DDoS attacks, server flooding);
- distributing malware through the Service;
- impersonating other persons or entities;
- operating competing services using the Provider's infrastructure.
10. Limitation of Liability
- The Provider is not liable for the content of messages sent via the contact form between third parties and Users.
- QrKontakt is not an emergency, rescue, life-safety or property-protection system and is not a way to contact emergency services. It must not be relied on where immediate action is required or a delayed message could cause harm.
- The Provider uses reasonable efforts to maintain security and availability but does not guarantee uninterrupted, immediate or error-free operation, scanning or delivery of messages, email, push or location. The Service is offered "as is" and "as available".
- To the fullest extent permitted by law, the Provider's aggregate liability to a non-Consumer User for all events in any 12-month period is limited to the amount actually paid by that User for the Service during the 12 months preceding the event giving rise to the claim.
- This limitation does not apply to Consumers to the extent prohibited by Polish or EU consumer law.
- The Provider is not liable for the acts or omissions of third-party service providers (Stripe, PayNow, Furgonetka, Google, Apple).
11. Complaint Procedure
- Complaints regarding services, products or lack of conformity with the contract should be submitted by email to [email protected] or in writing to the Provider's registered address.
- The complaint should include: User name and email, description of the issue, date of discovery, and the requested remedy if the User wishes to specify one.
- The Provider will respond within 14 calendar days of receipt. Failure to respond within this period is deemed acceptance of the complaint (for Consumers).
- In case of lack of conformity of goods with the contract, Consumers may request repair or replacement and, in cases provided by law, a price reduction or withdrawal. The seller's liability generally lasts 2 years from delivery.
- Consumers may use out-of-court dispute resolution mechanisms available in Poland, including consumer ombudsmen, Trade Inspection mediation or consumer arbitration. Information is available at polubowne.uokik.gov.pl.
12. Right of Withdrawal (Consumers)
Legal basis: Art. 27 of the Polish Consumer Rights Act of 30 May 2014 (Polish law) / EU Directive 2011/83/EU
- Right of withdrawal. Consumers have the right to withdraw from a distance contract without giving any reason within 14 calendar days, pursuant to Art. 27 of the Polish Consumer Rights Act of 30 May 2014:
- from the date of contract conclusion — for services (subscriptions);
- from the date the Consumer takes possession of the goods — for physical products (QR Stickers).
- Procedure. To exercise the right of withdrawal, the Consumer may:
- use the form in the customer dashboard (section "My orders → order details → button 'Submit withdrawal request'"); or
- send an email to [email protected] stating: "I hereby notify my withdrawal from the sales contract for the following goods: [order no. ORD-…], contract date: […], name: […], address: […]."
Using the above template is not mandatory — any unambiguous withdrawal statement submitted before the deadline is sufficient.
- Return address. Goods must be sent to:

A sticker that has been applied to a surface and then removed loses its functional properties — the supplier's thermally activated adhesives are single-use and cannot be reapplied without loss of value. Pursuant to Art. 34(4) of the Polish Consumer Rights Act (Polish law), the Consumer is liable for any diminution in value resulting from handling the goods beyond what is necessary to ascertain their nature, characteristics and functioning. If damage or signs of use are found (e.g. the sticker was applied, packaging is damaged, accessories are missing), the Provider may reduce the refund by the estimated diminution in value. The Consumer will be notified by email of the reduced amount and the reason for the deduction.
- Return deadline. The Consumer must return the goods no later than 14 days from the date on which the withdrawal was communicated. The date of dispatch is determinative.
- Cost of return. The direct cost of returning the goods (return postage) is borne by the Consumer.
- Refund. The Provider will refund all payments received from the Consumer (including the cost of delivery to the Consumer at the cheapest standard option offered in the shop) within 14 days of receiving the withdrawal notice. The refund is made using the same payment method (PayNow → same card/account). The Provider may withhold the refund until the goods are received back or proof of dispatch is provided.
- Exceptions to the right of withdrawal (Art. 38 of the Polish Consumer Rights Act — Polish law). The right of withdrawal does not apply to:
- services fully performed before the withdrawal period expires only after prior express consent and acknowledgement of the loss of the right after full performance; activating a one-year service does not itself constitute full performance;
- digital content not delivered on a physical medium where performance began with the Consumer's explicit consent — applies to QR code files delivered by email;
- a standard purchase of physical stickers is not an exception — the Consumer retains the full 14-day right of withdrawal.

13. Intellectual Property
- All intellectual property rights in the Service, including source code, graphics, logos, and text, belong to the Provider or its licensors.
- Users receive a non-exclusive, non-transferable licence to use the Service for personal purposes only and in accordance with these Terms.
- Copying, modifying, decompiling, or creating derivative works from the Service without authorisation is prohibited.
- Content submitted by Users (messages, attachments) remains the property of the User or sender. Users grant the Provider a royalty-free licence to store and transmit such content solely as necessary to provide the Service.
14. Governing Law and Dispute Resolution
- These Terms are governed by Polish law.
- Any disputes arising from these Terms will first be addressed through amicable resolution.
- Disputes between the Provider and non-Consumer Users will be submitted to the court locally competent for the Provider's registered address.
- Consumer disputes may be brought before a court competent for the Consumer's or Provider's place of residence, in accordance with applicable procedural rules.
- Consumers may use out-of-court consumer dispute resolution mechanisms available in Poland, including assistance from UOKiK, Trade Inspection or a consumer ombudsman.
15. Changes to Terms
- The Provider may update these Terms for material reasons, including changes in law, authority decisions, court rulings, Service functionality changes, security requirements, technical or organisational changes, or price-list changes for future billing periods.
- Users will be notified of changes by email and via a prominent notice in the Service at least 14 days before the changes take effect.
- Changes do not affect Consumer acquired rights or services already performed. Users who do not accept the changes may terminate the agreement with immediate effect before the changes take effect.
