Terms of Service

1. Definitions

Service
The QRKontakt platform available at qrkontakt.com, providing the services described in these Terms.
Provider
The owner and operator of QRKontakt, a sole proprietor based in Poland.
User
Any natural or legal person who uses the Service after creating an account and agreeing to these Terms.
Consumer
A User who is a natural person acting for purposes outside their trade, business, or profession.
QR Sticker
A physical adhesive sticker containing a QR Code, ordered by a User and intended to be placed on a car window.
QR Code
A unique 16-character alphanumeric code (A-Z, 0-9) in XXXX-XXXX-XXXX-XXXX format, linked to a User's account.
Contact Form
A Service feature allowing anonymous messages to be sent to a vehicle owner after scanning a QR Code.
Subscription
Paid access to extended Service features, billed on a recurring basis (monthly or annually).

2. General Provisions

  1. These Terms govern the use of the QRKontakt Service, including the terms for entering into and terminating service agreements.
  2. By using the Service, you agree to be bound by these Terms.
  3. The Provider operates under Polish law, including the Act of 18 July 2002 on the provision of services by electronic means and the Act of 30 May 2014 on consumer rights.
  4. To use the Service, you need: an internet-connected device, a JavaScript-capable browser, and an active email address.

3. Account Registration

  1. Registration is free and requires providing an email address, name, and password, or logging in via Google/Apple OAuth.
  2. You must provide accurate information. Providing false data constitutes a breach of these Terms.
  3. You must be at least 18 years old to create an account. Minors may only use the Service with parental or guardian consent and supervision.
  4. Each User may hold only one account. Creating multiple accounts to circumvent limits or bans is prohibited.
  5. You are responsible for maintaining the confidentiality of your login credentials and all activities on your account.
  6. Your email address must be verified by clicking the activation link sent to the provided address.
  7. The Provider reserves the right to suspend or delete an account that breaches these Terms, following prior notice to cease the breach.

4. QR Stickers — Ordering, Activation & Deactivation

  1. QR Stickers are physical products ordered through the Service and delivered to the specified postal address.
  2. Each sticker has a unique QR Code linked to the User's account. One sticker cannot be assigned to multiple accounts.
  3. Activation occurs after the User registers the sticker in their dashboard, or automatically upon the first scan (if the account is active).
  4. A User may deactivate a sticker at any time from their dashboard, which will display an unavailability page instead of the contact form.
  5. Stickers are intended for lawful use only, specifically for placement on the window of the User's own vehicle.
  6. Reselling or transferring a QR Code to other individuals or platforms requires written consent from the Provider.

5. Anonymous Contact Service

  1. The contact form allows the person scanning a QR Code to send a message to the User without revealing either party's identity via the platform.
  2. The message is forwarded to the email address associated with the User's account.
  3. The sender provides their name and email address (required) and optionally a phone number. These details are visible to the User (the vehicle owner).
  4. The use of the contact form for the following is strictly prohibited:
  • spam, unsolicited advertising, or commercial communications;
  • harassment, threats, hate speech, racist, sexist, or discriminatory content;
  • malware distribution or phishing;
  • solicitation of personal or financial data;
  • any activity that is unlawful under applicable law.

Violations will result in immediate access suspension and may be reported to law enforcement.

6. Subscription and Pricing

  1. Current pricing is available at qrkontakt.com in the "Pricing" section.
  2. Available subscription plans:
    • Free Plan — basic contact form access, limited monthly messages.
    • Pro Plan — unlimited messages, push notifications, advanced analytics, priority support.
    • Business Plan — multiple vehicles, team features, dedicated support.
  3. Subscriptions auto-renew at the end of each billing period. You may cancel at any time from your account dashboard — cancellation takes effect at the end of the current billing period.
  4. Prices are in Polish Zloty (PLN) and include VAT where applicable.
  5. The Provider reserves the right to change prices with 30 days' notice for active subscriptions.
  6. Email notifications are free of charge for the entire duration of the Service's operation. The Provider reserves the right to discontinue the Service with 90 days' notice.

7. Payments

  1. Payments are processed by:
    • Stripe Inc. — card payments (Visa, Mastercard, American Express)
    • PayNow (mBank S.A.) — BLIK, online bank transfers, other Polish payment methods
  2. Card and bank account data is not stored on the Provider's servers — it is processed directly by the payment provider.
  3. A VAT invoice or receipt is issued promptly after payment confirmation and sent to the User's email address.
  4. For failed subscription payments, the Provider will retry up to 3 times within 7 days. If payment ultimately fails, the account will be downgraded to the free plan.

8. Shipping and Delivery

  1. QR Stickers are shipped via Furgonetka.pl (Apaczka S.A.) courier services or Polish Post.
  2. Estimated delivery time within Poland: 2–5 business days from the moment the order is accepted for fulfilment.
  3. Shipping costs are displayed in the cart before checkout and depend on the selected delivery method.
  4. Orders above a specified threshold (shown in the pricing page) qualify for free shipping.
  5. The Provider delivers within the Republic of Poland only. International shipping is available on request.
  6. The Provider is not responsible for delays caused by the courier or Polish Post.

9. Prohibited Content and Conduct

Users must use the Service lawfully and in accordance with these Terms. The following are prohibited:

  • infringing intellectual property rights of third parties;
  • uploading or transmitting illegal, offensive, defamatory, or harmful content;
  • attempting unauthorised access to the Service, other Users' accounts, or the Provider's IT infrastructure;
  • automated data scraping without the Provider's written consent;
  • disrupting the Service (DoS/DDoS attacks, server flooding);
  • distributing malware through the Service;
  • impersonating other persons or entities;
  • operating competing services using the Provider's infrastructure.

10. Limitation of Liability

  1. The Provider is not liable for the content of messages sent via the contact form between third parties and Users.
  2. The Provider does not guarantee uninterrupted or error-free operation. The Service is offered "as is" and "as available".
  3. The Provider's liability to non-Consumer Users is limited to the amount paid by the User in the preceding 12 months.
  4. This limitation does not apply to Consumers to the extent prohibited by Polish or EU consumer law.
  5. The Provider is not liable for the acts or omissions of third-party service providers (Stripe, PayNow, Furgonetka, Google, Apple).

11. Complaint Procedure

  1. Complaints regarding services or products should be submitted by email to reklamacje@qrkontakt.com or in writing to the Provider's registered address.
  2. The complaint should include: User name and email, description of the issue, date of discovery, and the requested remedy (repair, replacement, refund, price reduction).
  3. The Provider will respond within 14 calendar days of receipt. Failure to respond within this period is deemed acceptance of the complaint (for Consumers).
  4. Consumers may use out-of-court dispute resolution mechanisms (mediation, ODR platform: ec.europa.eu/consumers/odr).

12. Right of Withdrawal (Consumers)

Legal basis: Art. 27 of the Polish Consumer Rights Act of 30 May 2014 / EU Directive 2011/83/EU

  1. Consumers have the right to withdraw from a distance contract without giving any reason within 14 calendar days:
    • from the date of contract conclusion — for services (subscriptions);
    • from the date of receipt — for physical products (QR Stickers).
  2. To exercise the right of withdrawal, the Consumer must submit an unambiguous statement (e.g., email to zwroty@qrkontakt.com) before the deadline.
  3. For physical products, the Consumer must return the sticker in its original condition within 14 days of submitting the withdrawal notice. The direct cost of return shipping is borne by the Consumer.
  4. The Provider will refund all payments (including standard delivery costs) within 14 days of receiving the withdrawal notice, using the same payment method unless the Consumer agrees otherwise.
  5. The right of withdrawal does not apply to:
    • services fully performed with the Consumer's consent before the withdrawal period expires;
    • digital content delivered immediately upon purchase with prior consent and acknowledgement of loss of withdrawal right;
    • stickers manufactured to the Consumer's individual specifications.

13. Intellectual Property

  1. All intellectual property rights in the Service, including source code, graphics, logos, and text, belong to the Provider or its licensors.
  2. Users receive a non-exclusive, non-transferable licence to use the Service for personal purposes only and in accordance with these Terms.
  3. Copying, modifying, decompiling, or creating derivative works from the Service without authorisation is prohibited.
  4. Content submitted by Users (messages, attachments) remains the property of the User or sender. Users grant the Provider a royalty-free licence to store and transmit such content solely as necessary to provide the Service.

14. Governing Law and Dispute Resolution

  1. These Terms are governed by Polish law.
  2. Any disputes arising from these Terms will first be addressed through amicable resolution.
  3. Disputes between the Provider and non-Consumer Users will be submitted to the courts of competent jurisdiction in Kraków, Poland.
  4. Consumer disputes may be brought before a court competent for the Consumer's or Provider's place of residence, in accordance with applicable procedural rules.
  5. Consumers may use the EU ODR platform: ec.europa.eu/consumers/odr.

15. Changes to Terms

  1. The Provider reserves the right to update these Terms for material reasons, including changes in law, changes to services, or court decisions.
  2. Users will be notified of changes by email and via a prominent notice in the Service at least 14 days before the changes take effect.
  3. Continued use of the Service after the notice period constitutes acceptance of the new Terms. Users who do not accept the changes may terminate the agreement with immediate effect.
  4. The current version of these Terms is always available at qrkontakt.com/terms.
